The Constitution of the United States states the following:
No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.
Philip Berg, a Democrat activist from Pennsylvania filed suit against Barack Obama and the Democratic National Committee requesting proof that Barack Obama was a citizen eligible to pursue the presidency.
Lawyers for the defence have refused to produce evidence in the form of a valid certified Birth Certificate and instead have requested dismissal of the case.
